Keith Mallinson
Founder, Research Analyst, Consultant and Testifying Expert Witness
Keith has more than 30 years of experience in the ICT sector as a technical, commercial and financial research analyst, consultant and testifying expert witness. His work spans communications networks, digital platforms, artificial intelligence, intellectual property licensing and technology investment.
Prior to founding WiseHarbor in 2006, Keith held senior executive positions at a leading global industry analyst and consulting firm. His responsibilities extended across wireless and mobile communications, enterprise communications, computing, emerging internet technologies, and media businesses including cable and satellite television research and consulting practices.
Keith holds an undergraduate degree in Electronic Engineering from Imperial College London and an MBA from London Business School, including an academic exchange with Northwestern University’s Kellogg Graduate School of Management. His career has combined technical understanding, market analysis, regulation, economics and finance.
His published quantitative and qualitative research has addressed subjects including mobile broadband, spectrum allocation, communications infrastructure, software platforms, semiconductor technologies, intellectual property licensing, FRAND valuation, patent pools, open source and AI infrastructure economics. He is a regular industry commentator and author of numerous articles, reports and academic publications.
In a 2015 publication, Keith was first to accurately measure aggregate standard-essential patent royalties paid in smartphones. His published empirical work in SEPs is also preeminent in measuring the large biases and other inaccuracies in the patent counts that are commonly used by the courts and elsewhere to apportion aggregate royalties and to infer individual rates from cross-licenses.
Keith’s exceptionally long-term forecasts of usage growth and price declines, for fiber from 1999 to 2009 and mobile communications from 2010 to 2025, were prescient.
Keith has advised technology companies, investors including hedge funds, legal teams, industry organizations and policy makers worldwide. He has provided expert analysis and testimony in commercial litigation involving mobile communications products and services, telecommunications infrastructure including towers, patent licensing, valuations, damages assessments, contract disputes, and antitrust issues including alleged abuse of dominance, price fixing and tying.
He has testified in US bench and jury trials and has been deposed there dozens of times. He has also testified elsewhere nationally and in international arbitrations. His expert methodologies have never been rejected by any court and he has never been impeached or discredited as an expert witness.
Keith received Acquisition International’s Award for Best Mobile Communications Expert Witness 2024. He became a Practitioner in Residence at George Mason University’s Center for Intellectual Property x Innovation, and subsequently with The IP Policy Institute at The University of Akron School of Law.
